The Centre-State Division deals with the following matters:
1. CENTRE - STATE CONSTITUTIONAL MATTERS
- Constitutional crisis in States - Issuance of proclamation under Article 356 of the Constitution related to imposition and revocation of President's Rule in a State and other related matters.
- Inter-State Council matters which include recommendations made by Sarkaria Commission on Centre-State Relations.
2. MATTERS RELATING TO PRESIDENT, GOVERNORS AND NOMINATED MEMBERS TO RAJYA SABHA AND LOK SABHA
- Appointment, allowances and privileges of Governors of all States.
- Salaries, allowances and privileges of the President and Union Ministers.
- Pension and other retirement benefits to former Presidents and Vice Presidents.
- Nomination to Rajya Sabha under Article 80(1) (a) of the Constitution.
- Nomination of two Anglo Indians to Lok Sabha in accordance with Article 131 of the Constitution.
3. STATES' REORGANISATION
- The demand for formation of new States / Union Territories.
- Interpretation of provisions of the State Reorganization Act, 1956 and other reorganization laws.
- Inter-State boundary disputes except disputes between / among the North Eastern States.
- Apportionment of Assets & Liabilities among reorganized States under reorganization laws.
- Constitution of Development Boards under Article 371 (2).
4. ZONAL COUNCILS
- Financial and administrative matters regarding the Zonal Councils that require sanction of the Government of India.
- There are five Zonal Councils created under the provisions of the States Reorganization Act, 1956, viz. Eastern Zonal Council, Central Zonal Council, Western Zonal Council, Southern Zonal Council and Northern Zonal Council. The Councils are headed by the Union Home Minister and Chief Ministers from each State in the Zones are represented. These Councils aim at providing common meeting ground and resolving inter-State and Central-State problems.
5. PREVENTION AND CONTROL OF CRIME
- 'Police' and 'Public Order' are State subjects. However, the MHA has from time to time been advising the State Governments to give more focused attention to improving the administration of the criminal justice system with a view to ensure effective prevention and control of all crimes with emphasis on mitigating crime against the vulnerable sections of society, such as, the SC/ST, women, children and the old persons.
